That's clearly a 50 star flag in 1940.

There are several listings on eBay, it was in use for nearly 50 years so it was relatively widespread.

A 49-star US flag is pretty rare though, as it was only in use for a single year.

Most Europeans are unaware of the miniscule differences between the 46, 48, 49 and 50-star flag variations and I doubt the average American moviegoer would notice either.
