It's two different cars. The main one has a 1928-1929 grille shell and the background one has a 1931 grille shell. Also note different bumpers, non-original on the main one and original bumper on the background one. The main one has a more modern front suspension with coil springs, I'd guess that either the front suspension is changed or that the body is riding on a modern frame.
