its definatly a ti, in the second photo you can see the high mount taillight centered at the top of the rear glass pane. the ti is the only e36 with that feature in the US (not sure about the estate e36, but that dosen't matter since this car is obviously not an estate). and you can make out the "t" from "ti" in the second photo if you zoom in a bit.
