I would make it to be a circa 1938 Pontiac 4 door sedan.

From this angle I don't think we can be sure if it is a '37 or a '38.

This is a 1937 Pontiac DeLuxe Touring Sedan. The silver streak chrome strips on the trunk are running over the whole trunk lid with a low placed make badge. On the 1938 cars the make badge was placed higher on the trunk lid at about 3/4 height and the streaks did not extend upwards beyond that badge not covering the upper trunklid curve .

Interesting story about this car. Some of the film was shot in Buffalo N.Y. Near Buffalo is Allegany N.Y. the home of the founder of the Pontiac Oakland International Club, Joe Oliver. Joe, who since past away, owned a 1938 6 cyl 4 door Pontiac. The car was yellow with black fenders and done up as Joe's Taxi. The film crew wanted to use this car in this scene but when they saw the car they realized it was too yellow and they offered to paint it yellow orange the correct taxi color. Joe's family refused the offer and the crew had to find a replacement, they found a local 1937 condition 4 car and had it painted along with the Buick that first appears in the scene. The movie Pontiac could be seen at local shows for a few years after the movie came out. I have eaten many times at the Park Side Candies. It was later an up scale restaurant for a few years but last time I was there the building was vacant. The elevated supports are movie props and were removed a week after the shot was taken. Joe's taxi can be seen in the 1938 section of John Gunnell's book 75 Years Of Pontiac Oakland.

this car is infact a 37 pontiac deluxe. i know this car very well as it belonged to my grandfather russell h. from cheektowa ny at the time of the filming.it was solid yellow and the film co had the fenders painted for the scene. it was a beautiful car but had a bit of a smoking issue... as previously stated he showed it for a few years after and sold it. his true love was his 29 model A.

mysprglide1200 I learned to drive in this Pontiac. I sold it to your Grandfather Russ. I have complete history of this car up until I sold it to your Grandfather. Is your mom Debbie? She can verify I'm not just giving you a bunch of BS. We can meet for coffee sometime as I would love to see the car again maybe get a ride in it again. Last time I saw it, it was at Tim Hortons in Springville about 10 yrs ago.
